Terms of Use

Consolidated version for using the platform and its paid modules and bundles.

1. Provider and contracting party

  • The provider of the Short Put Screener website and the information, content, and functions offered there, and the exclusive contractual partner of users, is Gasteiger Ventures GmbH, Schanz 3a, 6341 Ebbs/Tirol, Austria.
  • Historical price data, stock chart data, fundamentals, market data, and data on US equities and US equity options are sourced from the following providers:

2. Scope

  • These Terms and consumer information apply to use of the website and service and to the contractual relationship between users and Gasteiger Ventures GmbH.
  • Any conflicting terms of users do not become part of the contract, even if Gasteiger Ventures GmbH does not expressly object.

3. Users

  • The website and service are intended exclusively for natural persons aged 18 or older who enter into the contract for purposes predominantly outside their trade, business, or self-employed professional activity (consumers).
  • Private investors are natural persons who use the website and service exclusively for their personal private financial and/or capital investments, including those of close family members.
  • Users may access and use the website from other EU member states. Service quality may differ from the quality level in the user's country of residence.

4. Registration, access, and termination

  • Use of the website and service requires user registration. Users must provide first name, last name, country of principal residence, email address, and a password.
  • Email address and password are the access credentials for using the website and service.
  • Users must accept these Terms as well as data-source notices, disclaimer, and risk notices.
  • After registration and sign-in, users receive access to the available information, content, and functions, which may be expanded, reduced, or otherwise changed at any time.
  • Users may request termination of their user relationship at any time via support at support@shortputscreener.com.
  • Gasteiger Ventures GmbH may terminate the user relationship if the user does not log in for four (4) consecutive weeks. Users are informed by email at least seven (7) calendar days in advance and informed how termination can be avoided.
  • If no login occurs within the notice period, Gasteiger Ventures GmbH may deactivate, block, or archive the account and limit or discontinue access accordingly.
  • Gasteiger Ventures GmbH may continue to store account data as required by applicable law, especially for documentation, billing, security, or marketing purposes. Complete deletion occurs only where no statutory retention obligations apply or where a valid deletion claim exists.
  • Deleting a user account does not replace termination of an active paid subscription; the cancellation rules in Section 10 apply.

5. Paid modules and bundles, contract conclusion

  • Gasteiger Ventures GmbH offers paid modules and bundles as monthly or yearly subscriptions with extended information, content, and features.
  • Modules include Screener, Analyzer, and Planner. Bundles combine multiple modules.
  • The service and pricing details shown on the website are non-binding and do not constitute a legally binding offer by Gasteiger Ventures GmbH.
  • To conclude a subscription contract, users use the website checkout flow for the selected module or bundle.
  • By confirming the paid order button shown in checkout, users submit a legally binding offer to conclude a subscription contract.
  • Gasteiger Ventures GmbH confirms receipt of the order by email and thereby accepts the offer; this creates a binding subscription contract.
  • The contract language is German.

6. Right of withdrawal

  • When concluding a monthly or yearly subscription for a paid module or bundle, consumer users have a statutory right of withdrawal of fourteen days from the date of contract conclusion.
  • To exercise the right of withdrawal, a clear declaration in text form (e.g., email or letter) is required and must be sent to Gasteiger Ventures GmbH, Schanz 3a, 6341 Ebbs/Tirol, Republic of Austria, email: support@shortputscreener.com.
  • Timely dispatch before expiry of the withdrawal period is sufficient.

7. Refunds

  • If canceled in time during the trial period, no charges apply.
  • After a paid billing period has started, voluntary prorated refunds are generally not provided.
  • Mandatory consumer rights (including statutory withdrawal rights) remain unaffected.

8. Changes to paid services

  • Gasteiger Ventures GmbH may make minor changes to the scope of information, content, and features of paid modules and bundles where reasonable under good faith and balancing both parties' interests.

9. Prices

  • Prices are shown in USD and charged in USD.
  • Depending on region and applicable law, additional taxes may apply.
  • Your card issuer or bank may apply currency conversion and additional fees.
  • Final payable amounts are shown in checkout.

10. Free trial, contract term, and cancellation

  • The contract term starts upon contract conclusion.
  • For the first 14 days after contract conclusion, a 14-day free trial applies to the selected paid module or bundle. If no withdrawal is exercised within this period, the paid subscription term starts after the 14-day period ends.
  • Access to digital services is provided immediately during the trial period.
  • Users can choose between monthly and yearly subscriptions.
  • The paid monthly subscription starts after the trial, has an indefinite term, and can be canceled at any time effective at the end of the current paid subscription month.
  • The paid yearly subscription starts after the trial, has a minimum term of one (1) year, and can be canceled at the end of the first paid subscription year. If not canceled, the yearly subscription automatically renews for another year each time.
  • The right to extraordinary termination for good cause remains unaffected for both parties.
  • Users can cancel via the "Cancel subscription" button in Settings; if the button is temporarily unavailable, cancellation by email to support@shortputscreener.com is possible.

11. Payment

  • The payment methods available are those offered in checkout at the relevant time.
  • For monthly subscriptions, the monthly fee is due and collected at the beginning of each billing month.
  • For yearly subscriptions, the yearly fee is due and collected at the beginning of each billing year.

12. Timeliness of market data, disclaimer

  • Short Put Screener is an analysis and comparison service. It does not provide personal investment advice or recommendations to buy or sell securities or financial instruments.
  • Gasteiger Ventures GmbH does not make a public offer to acquire securities or financial instruments.
  • The website is not a trading platform for executing securities transactions. By creating texts and publishing market data, Gasteiger Ventures GmbH does not act as an asset manager or investment adviser.
  • Market data displays may lag in normal operation (typically by up to 30 minutes).
  • Before placing any transaction on a third-party trading platform, users should verify current market data and decide only on that basis.
  • Despite careful operations, no liability is assumed for inadvertent or erroneous market data.
  • Reference is expressly made to risk notices in their current version.

13. User obligations

  • Access credentials, especially passwords, must be kept confidential and protected against unauthorized access.
  • All user information must be truthful.
  • Users are not permitted to use the website, service, OPRA data, or other market data for purposes other than their own private purposes, nor to pass such data to third parties, provide access to third parties, distribute, or publish it.
  • Any changes to data provided during registration or ordering must be communicated without undue delay.

14. Statutory warranty and limitation of liability

  • In the event of defects in the service, statutory warranty rights apply.
  • Gasteiger Ventures GmbH has unlimited liability for intent and gross negligence.
  • For ordinary negligence, Gasteiger Ventures GmbH is liable only for breach of essential contractual duties (cardinal duties); in that case liability is limited to foreseeable damage typical for this type of contract.
  • These limitations do not apply in cases of injury to life, body, or health, liability under product liability law, assumed guarantees, or the absence of warranted characteristics.
  • Where liability is excluded or limited, this also applies to personal liability of employees, staff, representatives, governing bodies, and agents.
  • Reference is expressly made to risk notices in their current version.

15. Final provisions

  • If individual provisions are incomplete, wholly, or partly invalid, the validity of the remaining provisions remains unaffected.
  • These Terms may be changed with four (4) weeks' notice where the change is reasonable for users, taking into account both parties' interests.
  • The power to change terms does not apply to essential parts of the contractual relationship, in particular type and scope of core mutual services and contract term.
  • Changes are announced by email to the last provided email address. If no objection is made within the specified period, the change is deemed accepted.
  • Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods.
  • Gasteiger Ventures GmbH does not participate in dispute resolution before a consumer arbitration body. Under EU Regulation No. 524/2013, the European Commission provides an Online Dispute Resolution platform (ODR): https://ec.europa.eu/consumers/odr/.
